In March, 1722, he sent his accountant, Francisco Menendez Marques, to Charleston to demand the immediate destruction of the fort. In his representations to the Carolinians Menendez protested the flagrant disregard of that “sacred document,” the Treaty of Madrid of 1670, and demanded that existing agreements between England and Spain guaranteeing colonial territory be respected. [Note 72: gov to king 4/21/1722] The governor of Carolina, Francis Nicholson, paid little attention to Menendez’s allegations. The governor explained that he had received no word from England concerning peace between Spain and England. As far as Nicholson was concerned, Spain and England were still at war. As his only concession, the Carolinian agreed that if he received word of a change in Anglo-Spanish relationships he would settle the matter of Fort King George with Benavides. In the meantime his men would continue to occupy the blockhouse on the Altamaha. Unable to sway Nicholson, Menendez returned to Saint Augustine without obtaining any satisfaction.
