In Spain there was also concern over Fort King George. Both Philip V and the Council of the Indies saw the structure as a clear infringement of Spanish rights in Florida territory. Both the king and the Council used the traditional rationale of papal donation, prior discovery, exploration, occupation, and treaty rights, to demand the immediate destruction of the fort. [Note 74: fiscal 9/11/1722] In October, 1722, the Council ordered the Spanish ambassador in London, Jacinto Pozobueno, to request the immediate evacuation of the small English outpost on the Altamaha. If the English seemed reluctant, the ambassador was to threaten forcible action by the governor of Florida. Orders also went out to the viceroy of New Spain and the governor of Cuba to gird for war should the English fail to meet the Spanish ultimatum on Fort King George.
